Resumo
El trabajo investigativo consistió en conocer el contexto de las amnistías tributarias en Colombia desde el siglo XX hasta nuestros días. Señalar los requisitos para que una amnistía sea constitucional de acuerdo con las sentencias de la Corte Constitucional y exponer los casos donde la misma Corte declaró contrarias a la Constitución algunas de las amnistías.
En el desarrollo del trabajo se explicó las diferentes clases de amnistías que pueden llegar a existir. Por ejemplo se tomó el régimen para declarar activos omitidos y pasivos inexistentes en el país y como alguno de los intentos de reforma a ese régimen ha sido considerado una amnistía tributaria inconstitucional por la Corte Constitucional.
Además el trabajo aporta una mirada internacional de las amnistías, recalca la recomendación del Fondo Monetario Internacional de que se deben evitar las continuas amnistías para no producir un efecto adverso en el contribuyente cumplido. Finalmente, el trabajo investigativo sugiere algunas alternativas para evitar se generalicen este tipo de medidas tributarias en el país.
Abstract
This thesis is an attempt to get to know the context of tax amnesties in Colombia from the 20 th century until nowadays. Along this paper different kinds of amnesties were identified, for instance cases where the tax amnesties were found in line with the principles of Colombian Constitution but we should say that cases where the constitutional statements were disregarded were the most.
In addition, it examined in further details the constitutional statement coming from Constitutional Court of Colombia by doing so were listed the requirements to consider a tax amnesty adjusted to Colombia constitution according to court decisions.
To conclude, the “moral hazard” theory is mentioned to remark the potential adverse effect that many and frequent tax amnesties could have on the good taxpayer.
It explained the framework of “activos omitidos and pasivos inexistentes” and their relation with a tax amnesty.
At the end, some alternatives were identified to avoid countless tax amnesties.
