Climate Change and Economic Instruments: Proposals of Legal Regulation for an Emissions Trading Scheme for ChileResumen
El artículo inicia con un examen de los instrumentos económicos que, según la doctrina, deben ser parte de las políticas climáticas, algunos cuya creación se ha dispuesto en Chile, como es el llamado ‘impuesto verde’ y otros en proceso de estudio, como son los mercados de emisiones. Aborda los fundamentos jurídicos de estas herramientas en contextos climáticos y revisa la arquitectura climática para caracterizarla brevemente en base a las principales medidas de adaptación y mitigación que son parte de este entorno. Examina el mercado de emisiones más conocido que es el europeo (EU ETS); para concentrarse en este mecanismo a fin de considerar los principales desafíos que enfrenta Chile para implementarlos y hacer recomendaciones de regulación jurídica de cómo debiera incorporarse a la realidad chilena.
Abstract
The article begins with an examination of the economic instruments that, according to the doctrine, should be part of climate policies, some of which have been created in Chile, such as the so-called "green tax" and others in the process of being studied, such as the emissions markets. It addresses the legal foundations of these tools in climate contexts and reviews the climate architecture to characterize it briefly based on the main adaptation and mitigation measures that are part of this environment. It examines the most well-known emissions market, the european (EU ETS); to concentrate on this mechanism in order to consider the main challenges that Chile faces in order to implement them and make recommendations on legal regulation of how it should be incorporated into the Chilean reality.
