Las instituciones no son per se fuentes de seguridad jurídica, son un actor fundamental en los mercados que debe ser estudiado al momento de tratar de explicarse el mejor o peor funcionamiento de los mismos. En las sociedades existen sistemas de incentivos que dirigen o incitan a los individuos a comportarse de determinada
manera, a tomar determinadas decisiones. De esta comprobación surge la necesidad de analizar el comportamiento de las instituciones y su relación con el sistema de incentivos que genera para los individuos, con el fin de determinar si su influencia sobre el funcionamiento económico es positivo o negativo. La Rama Judicial es una de esas instituciones públicas que juega un papel preponderante en el intercambio y en el funcionamiento de la sociedad en conjunto. El modelo explicativo de fallas del mercado aplicado al sistema judicial desde una perspectiva del análisis económico del derecho, pone en evidencia que la crisis del sistema
judicial colombiano no se explica únicamente en función de deficiencias administrativas sino que guarda una directa relación con la forma en cómo los particulares se relacionan con el mismo. Toda esta red de relaciones genera un sistema de incentivos que explican el porqué del funcionamiento y los resultados del sistema.
Abstract
Institutions are not, by their one means, a source of estability in the law system, they are only one of the fundamental actors that play a role that needs to be explained and studied when understanding the dynamics of markets. Among individuals there is a complex system of incentives that have a big influence in the choices they make and in the way they will interact one with another. The relationships between institutions and the network of incentives they imply appear to be fundamental when understanding the economics of a certain society. The judicial system is one of those Institutions that plays a preponderant role in the Systems of Exchange and the well functioning of societies as a whole. We consider that an analysis of the Colombian judicial System, of the network of incentives it implies, the transactions costs it produces, and in general its possibilities as a market, is basic when trying to understand de causes of its crisis and the effects produced in
economic performance.
