Resumen
El proceso de la integración andina en el marco de la protección al consumidor, debe ser una herramienta que sirva a los Estados miembros de la CAN (Colombia, Perú, Ecuador y Bolivia), para proteger al consumidor dentro de un mercado comunitario. La Decisión andina que se profiera en materia de protección al consumidor, deberá tratar por lo menos tres pilares fundamentales del Derecho del consumo, la responsabilidad por garantía legal, por producto defectuoso, y por la información que se da a conocer al consumidor acerca del producto ofrecido; temas que permitirán a los consumidores andinos ya no solo acceder a un mercado común, sino a productos que cumplan con condiciones de calidad, idoneidad, seguridad y eficiencia. Condiciones que deberán garantizar todos aquellos productores o proveedores que quieren comercializar sus productos en el mercado común andino, y en general entrar a la sociedad del consumo, así lo destaca (Carrión, 2010, pág. 75) : “En efecto, el Derecho del Consumidor nace, se desarrolla y se justifica en la sociedad de consumo y regula la producción y la comercialización de productos y servicios a través del prisma del consumo, y éste, tiene un lugar cierto: la vida cotidiana. Nada puede ser más actual que algo que se propone proteger la vida cotidiana de los individuos”.
Abstract
The process of Andean integration within the framework of consumer protection must be a tool that serves the member states of the CAN (Colombia, Peru, Ecuador and Bolivia), to protect the consumer within a community market. The Andean Decision that is proffered in terms of consumer protection, should address at least three fundamental pillars of consumer law, liability for legal warranty, for defective product, and for the information that is made known to the consumer about the product offered issues that will allow Andean consumers to not only access a common market, but products that meet quality, suitability, safety and efficiency conditions. Conditions that must be guaranteed by all those producers or suppliers that want to market their products in the Andean common market, and in general enter the consumer society, highlights (Carrión, 2010, page 75): "In fact, the Law of Consumer born, developed and justified in the consumer society and regulates the production and marketing of products and services through the prism of consumption, and this has a certain place: daily life. Nothing can be more current than something that aims to protect the daily lives of individuals.
