La esclavitud es un fenómeno que ha existido a lo largo de la historia. Dicha práctica ha intentado mitigarse con la creación de distintos organismos internacionales a través de los años, sin embargo, a pesar de estos esfuerzos que se han realizado para respetar los derechos humanos, existen todavía millones de personas atrapadas en las distintas formas de esclavitud moderna, siendo el trabajo forzoso una de ellas. Brasil es uno de los tantos países que afrontan esta problemática en la región latinoamericana habiendo sido abolida la esclavitud 130 años atrás. Por ello, ha emprendido esfuerzos desde el gobierno, y en conjunto con la Organización Internacional del Trabajo, de generar leyes y programas que ayuden a mitigar el trabajo forzoso en el país.
Teniendo en cuenta lo anterior, el presente trabajo tiene como objetivo general analizar la influencia de los regímenes internacionales de derechos humanos en el comportamiento de Brasil frente al trabajo forzoso durante los años 2002 y 2007. Con este fin, la pregunta de investigación es la siguiente: ¿Cuál es la influencia de los regímenes internacionales de derechos humanos en el comportamiento de Brasil frente al trabajo forzoso durante los años 2002 y 2007 en el caso Pagrisa? Esta pregunta se responderá, bajo el marco de la teoría del institucionalismo neoliberal, determinando las Organizaciones y Tratados internacionales que aborden el trabajo forzoso que Brasil haya ratificado; definiendo las estructuras políticas y normativas que el Estado de Brasil ha realizado frente al tema; y por último, contrastando la aplicación de los regímenes internacionales en el caso de la empresa Pagrisa.
Abstrakt
Slavery is a phenomenon that has existed throughout history. This practice has been tried to be abolished with the creation of several international organisms over the past years. Despite the efforts made to protect human rights, there are still millions of people trapped in the different forms of modern slavery, being forced upon one of them. Brazil is one of the many countries that faces this problematic in the Latin American region, even though slavery was abolished 130 years ago. For this reason, the government, with the International Labour Organization, has undertaken efforts via generating programmes and laws that help to mitigate forced labour in the country.
Taking into account the previous information, the present investigation has, as main objective, to analyze the influence of the international regimes of human rights in the Brazil's behaviour against forced labour during 2002 and 2007 in Pagrisa's case. According to this purpose, the research question is the following: What is the influence of the international regimes of human rights in Brazil's behaviour against forced labour during 2002 and 2007 in Pagrisa's case? This interrogation is going to be answered, under the framework of the neoliberal institutionalism theory, firstly, by determining the International Organizations and Treaties that address forced labour and that Brazil has ratified. Second, to define the political and normative structures that Brazil has made in relation to the issue; and finally, by contrasting the application of the international regimes in the case of Pagrisa.
