dc.description.abstractEl presente texto pretende ilustrar a los lectores acerca de una de las situaciones que, en opinión de los autores, actualmente implica un desequilibrio procesal en el Sistema Interamericano de Derechos Humanos: la acumulación de etapas procesales dentro del conocimiento de peticiones individuales y casos contenciosos, por parte de la Comisión Interamericana de Derechos Humanos y la Corte Interamericana de Derechos Humanos, respectivamente. De esta forma, los autores intentarán poner de presente que esta práctica de acumulación en ocasiones pone en peligro las garantías de quienes intervienen dentro de los mencionados procesos. Para ello, se hará una descripción de cómo ha sido adelantado en la práctica el fenómeno procesal de la acumulación de etapas procedimentales en el Sistema Interamericano de Protección de los Derechos Humanos (II). Posteriormente, se explicará por qué la imposibilidad de realizar un reconocimiento de responsabilidad y al mismo tiempo interponer excepciones preliminares constituye una violación a las garantías procesales de las partes (III). Por último, se aportarán dos propuestas concretas que, en opinión de los autores, coadyuvan a solventar el desequilibrio procesal que en la actualidad produce la acumulación de etapas procesales en los referidos procesosde responsabilidad internacional del Estado (IV). spa
dc.description.abstractenglishThis text seeks to illustrate one of the situations which, in the authors’ view, currently involves a procedural disadvantage for the users of the Inter-American Human Rights System: the accumulation of the procedural stages of individual petitions and contentious cases, by the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights, respectively. The authors attempt to demonstrate that this practice sometimes threatens the guarantees of those involved in the aforementioned processes.Therefore, there will be a description of the practice of the accumulation phenomenon in the Inter-American Human Rights System (II). Later on, the authors will explain the States inability to recognize some kind of responsibility and, at the same time, fill preliminary objections, as an example of violation of guarantees (III). Finally, the authors will propose two procedural alternatives to solve the presented situation (IV).eng
