| dc.description.abstract | En el presente escrito, el autor efectúa un estudio de la lesión, partiendo de sus antecedentes históricos hasta su conceptualización por la doctrina, elementos configurativos y naturaleza jurídica. Acto seguido, el autor se detiene en el análisis de las normas del Código Civil peruano que han acogido el instituto, examinando sus presupuestos, ámbito contractual, casos de no procedencia, sanciones legales, titularidades y plazos.Por último, esboza una propuesta en el sentido de reformular la orientación del legislador en torno a las acciones propias de la lesión, proponiendo optar por la acción de reajuste de valores prestacionales por sobre la acción rescisoria. | spa |
| dc.description.abstractenglish | In this document, the author carries out a lesion study, starting with its historical antecedents until its conceptualization of doctrine, configurative elements and legal nature. Subsequently, the author analyses the norms of peruvian Civil Code that the institution has taken, examining its presuppositions, contractual scope, cases in wich there are no proceedings, legal sanctions, tittles and terms.Finally, he makes a proposition in wich he reformulate the orientation of the legislation with regard to the actions on the lesion, proposing to opt for the readjustment of the prestacionales values over that of the rescissory action. | eng |
