dc.description.abstractLa historia del Derecho Penal y Procesal Penal colombiano coincide con una progresiva marginación de la figura de las víctimas del delito del modelo de justicia penal. Las reiteradas reformas a la legislación consagran conceptos limitados que identifican a las víctimas del delito con el sujeto pasivo o titular del bien jurídico, dejando por fuera del proceso penal y sin ninguna atención a otras personas o grupos que sufren los efectos del delito. Los tiempos que corren imponen una nueva perspectiva del sistemapenal en la que se apunte a rehumanización del mismo sobre la base de hacer visibles a las víctimas y reconocer efectivamente sus derechos, los cuales deben tener un correlativo deber objetivado en la legislación y sancionado para quienes obstaculicen el cumplimiento del mismo.spa
dc.description.abstractenglishThe history of Criminal Law and Criminal Procedure in Colombia, coincides with a gradual marginization of the victims in the criminal justice model. The repeated amendments to the legislation identify the victims with the passive subject of crime leaving out of the criminal trial and without any attention other people or groups who suffers the effect of crime.As time goes by, the perspective of criminal law tends towards a more humanitarian system that effectively recognizes their rights, with a correlative obligation for those who try to hinder their fulfillment.eng
