dc.description.abstractUna teoría basada en conceptos axiológicos como los contenidos en el artículo 18 de la Carta Política, esto es libertad de conciencia y otros tan jurídico–normativos como los de autoría, ubicado en el artículo 29 del actual Código Penal; implican de suyo, discernir acerca de si exis- te una estrecha relación entre la moral y el derecho y si sus tópicos se ubican plenamente en el contenido de los bienes jurídicos expresados en la norma penal. Como centro del objeto de discusión diré que estos elementos contentivos de moralidad y derecho se encuentran dentro del concep- to de bien jurídico pues es, en última instancia, el lugar en el que el derecho penal ubica algunos bienes importantes, tomados de la socie- dad misma, y los protege de posibles vulneraciones de los individuos elevándolos a la categoría de norma penal; es precisamente de ese contenido del que vamos a tratar de dilucidar en esta sección. spa
dc.description.abstractenglishA theory based in axiological concepts like those contained in the 18th article of the political card, this is liberty of conscience and others as juridical normative as those of authorship, located in the 29th article of the penal code; whether there is a close relationship between moral and law, and if its topics are wholly included in the contents of juridical goods expressed in the penal norm. As the center of the object of discussion I will say that these mo- ral and law containing elements are framed within the concept of juridical wellness which it is, in this last instance, the place where penal law places some important goods, taken from society itself, and protects them from possible breakages of individuals by enhancing them to the category of penal norm.
