| dc.description.abstract | El presente artículo tiene como objetivo mostrar la importancia que posee la intervención estatal para lograr el restablecimiento y efectividad de la libre competencia económica cuando se presentan actos que configuran competencia desleal, se tomara como ilustración de esto el Caso Danone vs Alpina (expediente No. 09054397 SIC). Lo anterior se desarrolla en el siguiente orden: I) Se exponen brevemente los actos constitutivos de competencia desleal relevantes para el caso en estudio. II) Se plantea el deber impuesto por la Constitución y los tratados internacionales al Estado de impedir que se restrinja la libertad económica. III) Se hace una consideración acerca de la importancia que tiene para el bienestar social la puesta en práctica de la libre competencia económica y por ello la relevancia que posee la intervención estatal para impedir los actos de competencia desleal. IV) Se esboza el caso en estudio, se describe cómo se realizó la intervención por parte de la Superintendencia de Industria y comercio para restablecer el buen funcionamiento del mercado y su motivación, resaltando la importancia que tiene dicha intervención. | dc.description.abstractenglish | This article aims to show the importance of the Government intervention as a method of restoration and effectiveness of the free economic competition on those events when unfair competition acts take place, by taking for example the DANONE versus ALPINA (SIC Case file No. 09054397). To achieve the above, I) it will be necessary to briefly describe the different unfair competition acts relevant to the study case; II) determinate the importance and related obligations imposed on the Colombian Constitution and international treaties that prevents the economic freedom restrictions. III) This article stands the practice of free economic competition to get a social welfare together with the importance of government interference. IV) It would be necessary to outlines the study case to describe how the intervention was conducted by the mentioned Superintendent, in order to restore the proper functioning of the market and highlight the importance of such intervention.
