| dc.description.abstract | Este artículo muestra las estrategias de priorización utilizadas en la comunidad internacional en procesos de justicia transicional de naturaleza similar al adelantado en Colombia, mediante la implementación de la Ley 975 de 2005 o Ley de Justicia y Paz, LJP. El objetivo del artículo es realizar algunas recomendaciones para construir una estrategia de priorización de casos específica para el contexto colombiano.El artículo concluye que se debe priorizar la investigación de casos que muestren la estructura de los crímenes de sistema cometidos por los paramilitares. A su vez, resulta necesario incorporar otros criterios de priorización de casos en los que se destaquen los “mayores responsables” dentro de la organización criminal y también la adopción de criterios de priorización que permitan la investigación de aquellas conductas que atentaron de forma más grave contra los derechos de las víctimas. Por último, se debe tomar en consideración el criterio de efectividad y eficiencia que conduzca a victorias de carácter probatorio y procesal por parte de la Unidad de Justicia y Paz. | spa |
| dc.description.abstractenglish | This article shows the prioritization strategies used in the international community in cases of transitional justice similar in nature to those advanced in Colombia through the “Justice and Peace Act” or Act 975 of 2005. The aim of this paper is to make several recommendations for building a strategy for prioritization of specific cases in the Colombian context.The article concludes that the criminal investigations should focus on individual cases that reveal the typical structure, chain of command, and modus operandi of crimes committed by the Colombian paramilitary forces. The article shows that it is necessary to incorporate criteria for prioritizing cases that emphasize the identification of those individuals bearing the “highest responsibility” for the crimes committed; the investigations should target those cases that involved the most serious attacks against the human rights of victims. Finally, in descending order, the investigative strategy of prioritization should prefer those cases that would lead to efficient and exemplary results in light of the very resources that the Attorney General's Office has at hand. | eng |
