dc.description.abstractEl presente trabajo estudia la responsabilidad del superior sensu stricto por crímenes de guerra en el derecho internacional. Luego de hacer referencia a algunos aspectos de su naturaleza como responsabilidad por omisión, se examinan en detalle los tres elementos que la originan. De manera general, éstos son: 1) la existencia de una relación superior-subordinado; 2) el conocimiento del superior sobre los crímenes de guerra cometidos por sus subordinados (elemento subjetivo), y 3) el incumplimiento del superior de sus obligaciones de prevenir y sancionar los crímenes de guerra cometidos por sus subordinados. El análisis de las respectivas normas del Estatuto de la Corte Penal Internacional y de normas convencionales del derecho internacional humanitario así como la jurisprudencia de los tribunales penales internacionales para la ex Yugoslavia y Ruanda, constituyen las fuentes fundamentales para el examen de esta importante figura del derecho internacional contemporáneo. spa
dc.description.abstractenglishThe present paper studies the superior’s responsibility by war crimes according to the International law. After the revision of some aspects focused on its nature as responsibility by omission, its three constitutive elements are extensively examined. In general terms, these are: a) the existence of a superior-subordinate relationship; b) superior’s knowledge with regard to the war crimes committed by his/ her subordinates (mental element) and, c) that the superior does not fulfill his/her duties to prevent and punish the war crimes committed by his/her subordinates. The analysis of the International Criminal Court Statute and conventional norms of the International humanitarian law as well the jurisprudence of the International Criminal Tribunals for the former Yugoslavia and Rwanda are the main sources in order to study this important International law’s institution. eng
