dc.description.abstractEl tema central de este escrito es el de los acuerdos simplificados. Estos son una clase especial de convenios internacionales, que se “desprenden” de un tratado marco, es decir, de un convenio internacional de mayor dimensión. Ocurre que estos acuerdos simplificados, no tienen control por parte del Congreso ni de la Corte Constitucional, en la medida en que en teoría, no contienen obligaciones distintas a las establecidas en el tratado marco. Sin embargo, acontece en la práctica, que el presidente de la República viene suscribiendo acuerdos simplificados, que realmente no lo son, pues contienen obligaciones nuevas para el Estado colombiano, las que nacen sin control alguno. La tesis de este artículo, señala que con tales procedimientos, el presidente ha articulado un mecanismo de elusión o de evasión del control constitucional, que afecta los fundamentos de lo que pueda ser el proyecto del Estado constitucional democrático en Colombia.spa
dc.description.abstractenglishThis article relates to “simplified agreements”, which are a special class of international agreement that clarify treaty frameworks, that is to say, main treaties. Many simplified agreements occur outside the control of the Congress or the Constitutional Court. Theoretically, they should contain no state obligations other than those contained in the main treaty. However, the President of the Republic has executed a number of “simplified agreements” that are not, and which in fact contain new obligations for the Colombian state. These have been entered into without any control. The thesis of this article is to look at the procedures by which the President has managed a mechanism to elude and evade constitutional controls and have affected the fundamentals that ought to underlie the Constitutional Democratic State of Colombia. eng
