dc.description.abstractEl concepto de derecho marítimo es histórico y relativo. No es el mismo en las distintas épocas y países. Debe superarse el concepto legal acogido en cada ordenamiento para alcanzar un concepto esencial, atento a la realidad del tráfico y conforme con su naturaleza. A excepción de algunos ordenamientos, como el italiano o el argentino, en los que ha sido objeto de codificación independiente, el derecho marítimo se encuentra ubicado generalmente en los códigosmercantiles. Se identifica así con el transporte marítimo comercial. Pero su compleja realidad impone una concepción más amplia, como todo lo relativo a la navegación marítima, tanto en su dimensión privada, comercial o no, como público-administrativa. Por otro lado, el particularismo o peculiaridad de sus instituciones le hace configurarse como un derecho especial. Esta ampliación del criterio de delimitación del objeto del derecho marítimo, junto a la naturaleza especial de sus normas, supone avanzar en el reconocimiento de su autonomía sustancial, la cual no tiene su reflejo en una autonomía legislativa en algunos ordenamientos comoel español. De ahí el debate sobre la oportunidad de su reforma. spa
dc.description.abstractenglishMaritime law is a historic and relative concept. It has not remainedthe same regarding its application in different countries and overdifferent periods of time.In order to arrive at what is considered an essential concept ofmaritime law, one must first overcome how maritime law is appliedin several systems, in conformity with the reality and its nature.Unless the country, such as is the case with the Italian or Argentinelegal systems, has provided for an independent maritime code,maritime law is generally found in commercial codes. It is identifiedwith maritime transport. However, its complex nature demands abroader view, which necessarily includes all aspects of maritimenavigation, as well as other public-administrative aspects, whetherthey relate to commerce or not.Otherwise, the particularism or peculiarity of its institutions makes itappear like a special law.This amplification of the standards of limitation of maritime law,together with the special nature of its norms, works to advance theacknowledgement of its substantial autonomy, which does not have acounterpart in legislative autonomy like under Spanish law.Consequently, the debate begins about the status of maritime law andthe opportunity for reform.eng
